Surviving Spouse Precluded From Recovery of Settlement Proceeds for Abandoning Decedent

A husband who abandoned his spouse during her lifetime was denied any share of the wrongful death case brought by her fiduciary by Staten Island Surrogate Robert Gigante.  Children who have no connection to their parents can still share in such a settlement but a spouse must not have abandoned their spouse in order to be eligible to share in the settlement.
